Pidula Wakepark TERMS OF USE

1. These terms of use (hereinafter: the Terms) of Pidula Wakepark (hereinafter: the Wakepark) set out the rights, obligations and liability of the operator of the Wakepark, Pidula Wakepark OÜ (registry code 14975099), and the visitor to the Wakepark (hereinafter: the Customer) in respect of the use by the Customer of the cables located in the Wakepark (hereinafter: the cable).
2. The Terms apply to all Customers who use the Wakepark.
3. Pidula Wakepark has the right not to allow the Wakepark to be used by a person whose condition and/or abilities, in the opinion of the cable operator, do not allow them to ride the cable safely.
4. The Customer is aware that using the Wakepark may damage the Customer's clothing and the items they have with them and is dangerous to the Customer's life and health if the Customer does not strictly follow all instructions given by the staff of Pidula Wakepark, the safety and security requirements and the requirements set out in the Terms (hereinafter together: the Requirements). The Wakepark is used at the Customer's own risk (responsibility), and Pidula Wakepark is not liable for any damage incurred by the Customer (including damage to health and property) if the damage was caused by the Customer's failure to comply with the Requirements and/or the Terms and/or by the Customer's negligence when using the Wakepark.
5. The Customer is aware that when the Wakepark is ridden under the instruction of a member of staff of Pidula Wakepark, the member of staff of Pidula Wakepark has only an instructional role, and therefore in that case too the Wakepark is used at the Customer's own risk (responsibility); this includes that, in that case too, the adult is obliged to ensure the safety of the minors accompanying them in the Wakepark while they use the Wakepark.
6. The Customer may not use the Wakepark before receiving from a member of staff of Pidula Wakepark the instructions and the safety equipment for using the Wakepark safely. Before using the Wakepark, the Customer must make sure that the chosen Wakepark suits their physical abilities, state of health and skills.
7. To use the Wakepark, a person must be at least 120 cm tall, and persons under 14 years of age may use the Wakepark only with the consent of the adult accompanying them, who undertakes to supervise and ensure that the persons under 14 years of age accompanying them duly comply with all the Requirements and Terms.
8. Using the Wakepark while intoxicated as a result of consuming a narcotic or psychotropic substance or alcohol, consuming the said substances and smoking while using the Wakepark, and lighting fires on the premises of the Wakepark are prohibited.
9. The Customer undertakes to pay for the use of the Wakepark before using the Wakepark, in accordance with the current price list established by Pidula Wakepark.
10. When using the Wakepark, the Customer is obliged to follow all the Requirements and Terms, any additional instructions/orders of the staff of Pidula Wakepark, and the guidelines and markings located in the Wakepark.
11. Using the Wakepark without safety equipment is prohibited and is dangerous to life and health!
12. Passing the safety equipment on to another person is prohibited, and after a single use of the cables the safety equipment must be returned to Pidula Wakepark immediately. The Customer is obliged to use the Wakepark and the safety equipment with care and not to break or otherwise damage them, and to compensate Pidula Wakepark for all damage caused to Pidula Wakepark by damage to the Wakepark and/or the safety equipment as a result of the Customer's negligent or intentional conduct.
13. A member of staff of Pidula Wakepark has the right to call the Customer off the Wakepark immediately if the Customer breaches the Requirements and/or the Terms, does not follow the orders of a member of staff of Pidula Wakepark, or if, in the opinion of the member of staff of Pidula Wakepark, using the Wakepark is no longer safe. If the Customer's well-being deteriorates or the weather conditions change in such a way that using the Wakepark is no longer safe, the Customer must leave the Wakepark immediately.
14. Pidula Wakepark is not liable for the loss of, damage to or destruction of the Customer's clothing or other items.
15. The fee paid to Pidula Wakepark for the use of the Wakepark is refunded to the Customer only if the Wakepark cannot be used due to a circumstance attributable to Pidula Wakepark. In the cases referred to in clause 13 of the Terms, the fee paid by the Customer is not refunded.
